A couple weeks ago, I received a call from Governor Christie's Office inviting NJGCA to participate as a partner in the Governor’s Employment Opportunity Summit. This event will discuss and explore new, innovative ways to enhance employment opportunities and implement neutral hiring practices for NJ citizens with criminal records. Along with NJGCA, groups such as NJBIA, NJ Chamber of Commerce, NJ Restaurant Association and Koch Industries will be participating in the day’s events, and NJGCA is honored to have been asked.  I, unfortunately, will be in Washington DC with Eric for a couple days that week, so Jacy will be attending in my place. 
 
This program is about giving people second chances in employment, whether they have been through substance abuse and rehabilitation or have been convicted of a crime, sentenced to a punishment, and rehabilitated.  In my 23 years in the business, I hired numerous people who needed a second chance. There were success stories, and on one occassion it didn’t work out, strictly because the person being considered was simply unable to perform the job duties as expected.
 
I suspect many of you may be interested in this event because you know how difficult it is to find people willing to do the job. If you are willing to give someone a second chance, this is an appropriate forum for you to attend. Employers and employees both win, and this is about giving second chances to people who have truly demonstrated dedication and earned it.
 
The event is 10:00 AM – Noon on Wednesday, March 8th at Thomas Edison State University in Trenton.  It is FREE to attend. She will be there on the 8th, and I hope that many of my members decide to take advantage of this opportunity to learn more about a new program to prepare people to enter the workforce. Remember, NJGCA is one of only a handful of groups selected to participate and NJGCA members are the best in our industry.  Let’s represent them well!
 
Next, I was informed last Friday that a lawsuit was filed by the Speedway Corporation, challenging the constitutionality of New Jersey’s ban on Below Cost Selling. The case was filed in Superior Court in Mercer County, and is a direct result of two below cost selling complaints that I filed last October with the authorities. The parties involved were a Speedway and a 7-11. I have learned that 7-11 pled guilty and has been fined, but Speedway has decided to challenge the constitutionality of the law under which it was cited. We're in the process of consulting with our attorneys. As of right now, I don't know which Deputy Attorney General will be assigned to defend this case, and there will surely be a lot that develops in the weeks to come.  NJGCA will be very engaged as this moves forward.
 
Eric and I went to Bloomingdale on Tuesday night to oppose an ordinance intended to prohibit the sale of any tobacco products, including e-cigarettes, to anyone below 21, and impose a $750 license fee on any convenience store selling e-cigarettes.  In the past, I have reported that when I have had to testify in front of other municipal bodies I’ve been treated with harsh disrespect, however, the Mayor and Council in Bloomingdale were respectful, genuine and sincere as they posed questions and we debated the issues at hand.  The vote is scheduled for Tuesday, March 7th, and as I mentioned, I will be in Washington DC.  I will be following up to lobby the Mayor and Council Members one more time to seek their “no” vote.  As I always say when I discuss municipal tobacco issues, it would have been helpful if I had a member to accompany me this week, or even if I had someone who could also speak out against this proposal at the March 7th meeting. 
 
The City of Orange has also put a similar ordinance on their schedule for March 21, and we expect that many more municipalities will be doing the same in the near future. If you hear of your municipality considering a similar ordinance, please let us know. It would also be helpful if you can accompany us to the meeting. Hearing directly from the business owners who are affected will make a huge difference. We will be in touch with more details as we know them about the future of these tobacco issues all across the State.

Retailers to Supreme Court: Don't Revive Swipe-Fee Settlement
As retailers fight to keep debit card swipe-fee reform in place, they are also keeping an eye on a class-action settlement over credit card fees that was struck down in the courts. The National Retail Federation (NRF) and Retail Industry Leaders Association have asked the U.S. Supreme Court to let stand an appeals court ruling that struck down a 2012 settlement of a class action lawsuit over Visa Inc. and MasterCard Inc.'s credit card swipe fees. "This alleged 'settlement' was a backroom deal that would have done nothing to end price fixing or keep swipe fees from soaring in the future," NRF Senior Vice President and General Counsel Mallory Duncan said. "Even worse, it includes a provision that would keep merchants from ever suing over this issue again. The Circuit Court did the right thing in tossing this case out and it should not be revived. There are ways to bring swipe fees under control but this settlement is not one of them." According to Duncan, this is not just a business-to-business dispute. "These fees drive up the price of retail merchandise, costing the average family hundreds of dollars a year in added expenses," the executive added.  To read more about the history of the issue, click the link above.

FDA’s New Database on Grandfathered Tobacco Products
Feb. 15, 2007, is an important date in the Family Smoking Prevention and Tobacco Control Act, the law that authorizes the US Food and Drug Administration to regulate tobacco products. That date is known as the “predicate date” or “grandfather date.” Every tobacco product that was on the market as of Feb. 15, 2007, is grandfathered, which means that special applications do not need to be filed with the FDA to keep those products on the market. Just last week, the FDA announced that it has included on its website a searchable database to determine whether a tobacco product is grandfathered. Click here to access that database. To use it, type in the tobacco product name, the name of the manufacturer, select the product category from the drop-down list and then click the search button. The search results will inform you if the product is grandfathered. However, there is some confusion about the completeness and accuracy of the FDA’s grandfathered database. The Coalition of Independent Tobacco Manufacturers of America (CITMA), Richmond, Va., has issued a letter to its members outlining the issues with the FDA grandfathered database and allowed NATO to disseminate the letter.

Trenton hikes age to buy tobacco to 21 years old
Trenton has become the latest municipality to increase the age to legally buy tobacco in the city from 19 to 21 years old. City Council voted on Thursday to make the change, joining 21 towns across the state, including Princeton. The law takes effect in 20 days. The age limit applies to cigarettes, e-cigarettes, cigars, chewing tobacco, pipe tobacco and snuff.  The statewide age limit is 19.  Stores caught selling tobacco to anyone under 21 would face fines ranging from $250 to $1,000.  The city's health department can also suspend the retail food establishment license of a violator for up to three days. After twice postponing the vote, a revised ordinance was introduced earlier this month to expand the ban to include non-nicotine delivery devices and to make each sale, distribution or giving of tobacco to anyone under 21 a separate violation. Jim Brownlee, the city's director of Health and Human Services, said his environmental health unit will be working with retailers to inform them about the new requirement and provide them with the proper signs. While he and other health advocates said the ban would discourage teenagers from starting a harmful habit, critics argued it would just be another law on the books that goes unenforced.

NJGCA in the News: Cigar Market Remains Competitive
When the original Tobacco Control Act was signed into law on June 22, 2009, the U.S. Food and Drug Administration (FDA) was given “authority to regulate the manufacture, distribution and marketing of tobacco products.” The government was primarily concerned with cigarettes at the time -- but since that day cigars have been enveloped into regulation. On Dec. 9, 2016, the FDA issued warning letters to four tobacco manufacturers -- Swisher International Inc., Cheyenne International LLC, Prime Time International Co. and Southern Cross Tobacco Co. -- for selling flavored cigarettes that are labeled as little cigars or cigars, a violation of the Family Smoking Prevention and Tobacco Control Act. The decision touches upon a debate regarding what connotes a cigarette and what connotes a small cigar. One of the manufacturers, Swisher, issued a formal response that there should be no confusion with its product line. Swisher stated that it doesn’t believe any action is necessary on the part of convenience stores in regard to its little cigar products at this time. The manufacturer also responded that Swisher Sweets Little Cigars are, and have long been, properly classified as cigars and not cigarettes under federal law and are thus not subject to regulation as ‘cigarettes’ under the Tobacco Control Act. Another Way to Save on Your Energy Bills

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.

Remember when you sign up your energy through the NJGCA Energy Program, TMP makes a considerable donation to the NJGCA Scholarship Fund through their proceeds. This has no affect on your rate, and costs you nothing out of pocket.
