REMINDER: Contact NJGA If You Have Received a Certified 'Demand Letter' From Tauler Smith Law Firm

MEETING AT NJGCA HEADQUARTERS MONDAY, MARCH 12TH AT 2PM! 

IMPORTANT meeting at NJGCA headquarters for all those who are included in the NJGCA efforts to resolve the matter of “Demand Letters” sent by the Tauler Smith law firm to convenience store owners regarding the sale of male enhancement products.
 
Several messages regarding certified letters that were sent to members who operate convenience stores have previously been sent to you. These letters were attached to a
THREATENED LAWSUIT regarding the sale of Male Enhancement products that are being sold in their convenience stores. Once again, it is important to understand that NJGCA has investigated the matter and has found that these letters are neither a scam nor a joke, and this matter must be dealt with properly in order to prevent serious and costly legal exposure.

Please be advised if you are carrying any of these products in your stores, they should be REMOVED IMMEDIATELY if you are currently or have EVER sold them. Besides the civil claim that is being made by the Tauler Smith law firm, the products mentioned in their letter contain the active ingredients that are in the prescription drug VIAGRA, and you can be charged by law enforcement for selling a prescription drug over the counter.
 
If you have received this certified “Demand Letter” you should contact NJGCA immediately, as our attorney Frank Brennan has already been in touch with the Tauler Smith law firm to resolve this matter. Many of you have already sent us PDFs of your documents, but we believe there are many more out there that have not contacted us yet.
 

Further, there will be a meeting here at NJGCA Headquarters on Monday 3/12 at 2PM for all of those who have received this demand letter and have sent their documents to NJGCA to be included in our efforts.
 
Based upon this telephone conference, it is clear that Tauler Smith has issued many letters to retailers in New Jersey. 
Even if you have not received the letter mentioned in this communication, but you have sold the products mentioned in the letter, you should contact NJGCA, as we are expecting more letters to arrive in the future based on information from other states. Lawyers in several other states have contacted NJGCA once they learned of our efforts as similar letters were received by convenience store owners in their states too.  We will share more on Monday in person with you. It is clear that this law firm intends to prosecute these alleged violations in order to ensure that the products are removed from retailer shelves and to collect monetary damages.

NJGCA is providing Tauler Smith with a list of members in our negotiating group. This will give those members protected status while the negotiations unfold. Otherwise, members would be exposed to prosecution in accord with the demand letters. NJGCA can’t protect you unless we know who you are. NJGCA members also should be reminded that these are very serious and potentially very costly claims and that Tauler Smith is a law firm that exists solely to prosecute claims such as this.
 

Therefore it is imperative that ALL LOCATIONS that are in receipt of one of the Tauler Smith demand letters contact NJGCA immediately. We will need a scanned PDF copy of the entire 25 page document that was received at EACH location.  If you do not have the ability to scan the document then you must bring it to NJGCA headquarters ASAP and we will scan it for you. ONLY the locations that we can identify in our communications with Tauler Smith will be included in our umbrella. This matter is urgent and time is of the essence. Please call NJGCA HQ with any questions. Please ask to speak with Michelle.
