RENEWED EFFORTS TO RAISE TOBACCO PURCHASE AGE TO 21
EXCESSIVE TAX LEVIED ON SODA AND SUGARY DRINKS IN PA … COMING SOON TO NJ?

It’s a New Year, but many of the same crappy proposals from years past continue to haunt us. First to resurface was an effort to raise the tobacco purchase age to 21. It is clear that we'll have to continue to fight this issue in municipalities across the State, starting with Paramus (which we defeated last year but has risen again), and the City of Trenton. We were lucky to learn about the renewed efforts in Paramus ahead of time, and we plan to have another meeting with the Mayor, which helped us greatly the last time this proposal was being considered.

However, we did not learn about the City of Trenton’s proposal until after it had been discussed at multiple town council meetings, and for that reason, I must urge you to be vigilant in your own towns and keep NJGCA informed! Unfortunately, there is no service to which I can subscribe to receive automatic updates about issues being considered in each of the 565 municipalities in NJ.  If there was, I’d do it!  Instead, I rely on you to be active and informed in your communities and then make NJGCA aware of any issues. We can handle statewide laws and regulations that are made in Trenton, but we need YOU to be our eyes and ears in local municipalities. 
 
The second issue is a new issue, not a recycled piece of garbage, but unfortunately it stems from NYC and Philadelphia, and like most of their bad ideas, I fear that it will soon find its way to NJ.  The issue I’m talking about is a tax on soda and other sugary drinks which is so severe that it is literally causing business owners to stop selling those staple items. The tax is levied at a rate of 1.5¢ per ounce, making it 24 times more expensive than Pennsylvania’s beer tax.  In practical terms, this means that some drinks end up being 2x more expensive after the tax is applied.  The idea that this legislation could be introduced in New Jersey is of extremely high concern for me.  The only silver lining is that I hope to be able to take all the evidence from what’s going on in Philly right now to prove to NJ legislators just how damaging this is, both to small business owners and to customers’ wallets.
 
Finally, I just have three quick updates:

  1. I've gotten multiple emails and phone calls about the 2017 Compliance Calendar. It is only available online (and of course, you can print it out yourself). To access the Calendar, click HERE.
  2. NJGCA’s first Diner Tour of the year will be on Thursday, January 19 at the Park Wayne Diner in Wayne at 9:30 AM. Come join NJGCA for a free breakfast and to start the year off with a look at what’s to come in 2017. You will also have the opportunity to bring your questions, concerns and suggestions to the table. We really value this 1-on-1 time with our members to make sure that we are serving you in the best way that we can! We hope to see you there! Please RSVP to this email if you plan to attend.
  3. Finally, NJGCA is partnering with NJ DEP to offer an exclusive training class on Underground Storage Tank Compliance and Enforcement. This class will provide information about Newly Proposed UST Regulations and the Underground Storage Tank Inspection Program. This is also a great opportunity to interact one-on-one with Compliance and Enforcement officials from the State and ask any questions you may have about the UST program! The class is Thursday, January 26 from 9:00 to 2:00 at the NJGCA office, and we will be offering both breakfast and lunch. It is only $25 for members to attend. A Refresher on FDA Retail Tobacco Compliance Checks
With the new year just beginning, it is important for tobacco retailers to be reminded about compliance checks conducted on behalf of the Food and Drug Administration. The FDA has been conducting tobacco compliance checks on U.S. retailers for the past five years. To conduct these compliance checks, the FDA contracts with an entity, usually a state government agency such as a health department or human services department, to carry out the retail store inspections. The FDA generally conducts two kinds of inspections: one involving an underage minor decoy who enters a store and attempts to purchase a regulated tobacco product; and the second involving a FDA contracted inspector who determines if other FDA tobacco regulations are being followed, such as the prohibition on self-service displays of cigarettes, RYO tobacco and smokeless tobacco (except in age-restricted stores that do not allow underage youth to be present in the store). 'Blatant robbery': Shops stop soda sales because of sugary drink tax
A Philadelphia hoagie shop has put the lid on selling sodas after a new tax was implemented on sugary drinks, according to Philly.com. Fink's Hoagies in Northeast Philly posted a photo of a sign that sits on the store's beverage refrigerator that informs customers that only bottled water will be sold. The sign say Fink's will not be part of the "blatant robbery" of Philadelphia through the unfair tax that was implemented because "most Philadelphia elected officials do not understand how to run a business nor balance a budget."  The tax was proposed by Philadelphia Mayor Jim Kenney as a 3-cents-per-ounce tax on beverages with added sugar. Preliminary approval to a bill with a 1.5-cents-per-ounce tax on drinks sweetened with sugar or artificial sugar substitutes was given by the city council committee. Soon afterwards, the full council passed that tax increase with a vote of 13 to 4 in June, making Philly the first big city in the nation to do so. The tax, which went into effect on Sunday, was begun to raise money for city initiatives. In some cases, customers are paying more for the tax than the beverage. But city officials say they expect the tax to raise $90 million this year and pay for pre-school, parks and recreation.

Most U.S. Drivers Leery of Auto Repair Shops
According to a new AAA survey, two out of three U.S. drivers do not trust auto repair shops in general – citing overcharges, recommendations for unnecessary services and poor past experiences for their lack of confidence. However, the survey also reveals that the majority (64 percent) of U.S. drivers have singled out an auto repair shop that they do trust, suggesting that consumers have prioritized finding a reliable mechanic in an industry with imperfect reputation. AAA urges all drivers to identify a reputable repair facility well before one is needed. “To minimize the stress associated with vehicle repair and maintenance, it is critical that drivers find an honest repair shop that they can trust with their vehicle,” said John Nielsen, AAA’s managing director of Automotive Engineering and Repair. “AAA found that one-third of U.S. drivers – 75 million motorists in total – have yet to find a trusted repair facility, leaving them vulnerable when trouble strikes.”

Another Way to Save on Your Energy Bills

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.

Remember when you sign up your energy through the NJGCA Energy Program, TMP makes a considerable donation to the NJGCA Scholarship Fund through their proceeds. This has no affect on your rate, and costs you nothing out of pocket.
