OSHA WARNINGS -- PLEASE PAY ATTENTION
STAGE II DECOMMISSIONING & NEW UST RULES

Earlier this week, I sent a wildfire alert because we were notified by members that they were being solicited to purchase OSHA compliance services. It seems that OSHA is targeting several industries in New Jersey and yes, the industries they are targeting are yours. Repair Shops, Gas Stations, and Convenience Stores are all in OSHA sights.  Obviously, many of you have paid attention to our warning as we have been receiving many emails and phone calls all week after the wildfire alert was sent. One of the main concerns of people that have contacted us has been the worry that they will be “calling the fox into the henhouse;” and I want to assure you all that that is not the case. I have had members ask “Should I use this program?  Will I be subjecting myself to problems?” OSHA responded to these questions with the following: 
 
“OSHA Onsite Consultation goes to great lengths to assist the “company” and not turn the case over to Federal OSHA.  Even the Federal program monitors how we use this Free Consultation Program and they do not want to see this happen.  Also the clients name, contact information, and the report is kept confidential from Federal OSHA.  The Consultation program helps companies come into compliance without the fear of fines or Federal OSHA citations.”
 
You need to pay attention to this, whether you are operating a repair shop, gas pumps, a convenience store, or all of the above. Please contact Debbie Hill here at HQ with any questions you may have, but first, you need to review the On Site Consultation Employer Obligations and Rights and complete the request form and send to Justin Baker and Keith Metz at the below addresses. Recently, I made mention of new rules that allow you to decommission stage II vapor recovery in addition to new underground storage tank (UST) rules that have been issued as of last month. The new rules can be cumbersome and difficult to understand, the procedures for decommissioning your stage II must be followed precisely to avoid running afoul of NJ Department of Environmental Protection (NJ DEP). Here is a link to the rules that I would like you to review. Parts of these rule changes are a major concern to us as they deal with testing of containment sumps, spill buckets, and under dispenser containment (UDC). I’m giving you a heads up, we are working with NJ DEP to put together a seminar to go over both the new rules and decommissioning as well as operator training. Right now, we have targeted several dates in mid-April and will let you know as soon as a date is confirmed.

 

I will be away for the next week with no access to cell phone or emails, our new communications director Michelle Horowitz will be sending next week’s Road Warrior to keep you updated on anything important that you should be aware of. I will write you again in two weeks.

Our one-day class will provide all the information for becoming a NJ Emissions Inspector, and the State will administer the written test the very same day at our offices!  We are offering the class: Thursday, February 15 from 7:00am to 3:00pm. ExxonMobil Invests in On-Demand Fueling Startup
ExxonMobil recently invested into Yoshi Inc., a Silicon Valley startup offering on-demand fuel delivery and vehicle care service. Yoshi Inc. provides a mobile one-stop-shop vehicle care service, bringing fuel-ups, oil changes and car washes direct to the consumer. Customers can schedule gas deliveries and other services directly from their smartphone or computer. ExxonMobil will provide Yoshi Inc. with fuels and lubricant products where available, and Yoshi Inc. will continue to manage the delivery service.

Over A Barrel: ExxonMobil Preps For The Low-Carbon Future
Exxon's scientists, including the 300 based in New Jersey, are spending $1 billion a year trying to solve one of the greatest challenges of our time: how to reduce emissions while supplying ever more energy to a world Exxon expects to grow to 9 billion people by mid-century. by 2025 the company intends to boost its U.S. oil production by more than 600,000 barrels a day and to get another 200,000 bpd from giant new discoveries off the coast of Guyana. But Exxon is also staring down a perfect storm of regulatory, social and shareholder pressure to clean up its act. What's needed, says Vijay Swarup, the Exxon exec who runs the Jersey research center, are innovations that meet the four criteria of being "affordable, scalable, reliable and sustainable."

Customers complain of 'tainted' fuel at Hamilton's Delta Gas Station
Mercer County officials ordered the Delta gas station off Route 33 and George Dye Road to shut down after the state Department of Environmental Protection imposed a “delivery ban” over concerns of tainted fuel.

$103 million drop in lottery ticket sales leads to $103 million payout for private company
The private company that runs New Jersey's lottery is on track to reap more than $1.4 billion in profit — even as sales slump and the firm has successfully lobbied to lower its promised revenue targets for the state by $1 billion. Northstar New Jersey will be paid more while it provides less revenue than promised to the state by the time its contract expires in 2029. Northstar oversaw a $103 million drop in lottery sales during 2017, but was still paid $103 million in fees and incentives, according to the lottery's yearly report.

Will Nuclear Subsidy Bill Kill Solar Sector?
A controversial bill to bolster nuclear power in the state may achieve that aim, but could also deal a crushing blow to New Jersey's thriving solar sector. The latest version of the legislation (S-877) contains dramatic changes in how the state promotes and incentivizes solar that could, in effect, kill the industry in New Jersey, according to even one of its own sponsors. The amendments essentially would alter the economics of investing in the sector and potentially erase much of the $9 billion in investments made in New Jersey over the past years, representatives of the solar industry said.

Another Way to Save on Your Energy Bills
We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 
 
This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.
 
Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group. Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.
 
If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills. There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.
 
The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.

Remember when you sign up your energy through the NJGCA Energy Program, TMP makes a considerable donation to the NJGCA Scholarship Fund through their proceeds. This has no affect on your rate, and costs you nothing out of pocket.
 
We hope to help hundreds of NJGCA members reduce their utility costs by participating in this and our other cost reduction programs.  Our purpose, in the endeavor, is to help NJGCA members lower their energy costs while supporting the NJGCA Scholarship Fund.
