This week's Road Warrior is coming a little earlier than usual, and will be a little shorter than normal!!  The most important thing I need you to be aware of is our upcoming Gas and C-Store Summit on November 30th (one week from today) at the Crowne Plaza in Monroe, NJ.  The event will have something for everyone!
  • Small businesses are affected by issues such as credit card fees, skimming, $15/hour minimum wage, and mandatory paid sick leave. 
  • Businesses could benefit from saving money on health coverage, workers compensation and liability insurance, and even earning dividends at the end of the year!
  • For people in the gasoline and c-store industries, we will have officials from Weights and Measures, DEP and OSHA to discuss items specific to your businesses. 
  • And, of course, we're thrilled that Lieutenant Governor Kim Guadagno will be our Keynote Speaker!!
As I said, the event is Wednesday, November 30th at the Crowne Plaza Monroe from 7:30 AM to 3:00 PM. Next, I have an update on a bill that prevents the sale of unsafe tires, which NJGCA supported when it was in Committee in the Assembly... If you recall, the bill lays out 7 different characteristics which would make a tire “unsafe.”  They are:
  • Has a tread depth of less than 1/16 inch measurable in any groove;
  • Has any damage exposing the reinforcing plies of the tire, including any cuts, cracks, bulges, punctures, scrapes, or wear;
  • Has any improper repairs, including, but not limited to:
  • any repair to the sidewall or bead area of the tire;
  • any repair made in the tread shoulder or belt edge area of the tire;
  • any puncture that has not been sealed or patched on the inside and repaired with a cured rubber stem through the outside of the tire; or
  • any puncture repair of damage larger than 1/4 inch;
  • Shows evidence of prior use of a temporary tire sealant without evidence of a subsequent proper repair;
  • Has a defaced or missing tire identification number;
  • Has inner liner or bead damage; or
  • Shows indication of internal separation, such as bulges or local areas of irregular tread wear.
Similar proposals have been supported in other states by the Tire Industry Association and the Rubber Manufacturers. We trust that none of our retailers would engage in these practices in the first place, and we are in full support of cracking down on any and all unscrupulous retailers who try to cheat their customers and endanger public safety.  The money these dishonest retailers pocket from such sales gives them a competitive advantage over good retailers and repairers.  The bill unanimously passed the Assembly this week and now goes to the Senate for consideration.
 
Additionally, in other tire-related news, the Senate passed a bill regulating the disposal of scrap tires.  We were originally concerned that the bill might add additional burdens to your tire-disposal process, and we worked to ensure that the version that was passed by the Senate does not give us any further burdens.  As long as you hire licensed disposers, the rest of the burden will be on them.  You must, of course, obtain a receipt for the load of tires when the hauler takes them from your property, so that you can prove that you engaged in proper disposal methods with a licensed hauler.  We will give you another update if the bill eventually becomes law.
 
Finally, we were prepared to remind you that a change in overtime rules would go into effect on Thursday, December 1st.  However, late last night, a judge ruled to delay the implementation of that change until the courts were able to rule on the legality of the issue. This “injunction” means that NO CHANGE WILL OCCUR ON DECEMBER 1st.  There is still the possibility that the eventual court decision will uphold the ruling and this change will become effective, however, the incoming Trump Administration has already expressed its interest in repealing the rule in its entirety.  Right now there are a lot of balls up in the air and a lot of different avenues that this issue can take.  We will continue to keep you in the loop with up-to-the-minute information as it comes out.

Judge Suspends Rule Expanding Overtime for Millions of Workers
A federal judge issued a nationwide injunction against an Obama administration rule which would expand the number of workers who would be eligible for time-and-a-half overtime pay by millions of people. The regulation was scheduled to take effect on Dec. 1.  It would raise the salary limit below which workers automatically qualified for overtime pay from $23,660 to $47,476. The judge ruled that the Obama administration had exceeded its authority by raising the overtime salary limit so significantly.  The ruling was hailed by business groups who argued the new rules would be costly and result in fewer hours for workers. The Labor Department said it “strongly disagreed” with the decision and was “considering all legal options,” raising the possibility of an appeal in the waning days of the Obama administration. Ross Eisenbrey of the Economic Policy Institute, whose writings on the subject helped shape the administration’s regulation, called the ruling “a disappointment to millions of workers who are forced to work long hours with no extra compensation.” While the injunction is only a temporary measure that suspends the regulation until the judge can issue a ruling on the merits, many said the judge’s language indicated he was likely to strike down the regulation.

Retail Associations Demand That Visa Fix Flawed EMV Rollout
New guidance from the Federal Reserve suggests that parts of Visa’s implementation of chip card technology may be illegal. A coalition of retailers has called on the card processor to fix issues with EMV’s controversial rollout. With new guidance from the Federal Reserve working in their favor, retail associations want answers regarding the migration to EMV chip card payment technology that their members have been working to comply with for more than a year. Earlier this month, the Fed added to its website new comments specific to the EMV transition. In a related FAQ, the agency notes that payment-card networks don’t comply with the Electronic Fund Transfer Act if the new payment terminals installed in retail stores require that payments are routed through a specific payment processor. “A payment card network inhibits a merchant’s ability to route electronic debit card transactions if it, by network rules, standards, specifications, contractual agreements, or otherwise, requires the merchant to allow the cardholder to make the choice of EMV chip application on a debit card, where one application routes only to a single network,” the Federal Reserve stated. This week, the Retail Industry Leaders Association, the Food Marketing Institute, the National Retail Federation, and multiple other retail groups sent a letter to Visa CEO Charles W. Scharf and CEO- designate Al Kelly, asking for information on how the company will respond to the Fed’s ruling.

Visa Responds to FTC Investigation with Rule Change
Visa has agreed to change its rules and requirements for payment system stakeholders regarding the rollout of EMV smart chip technology in the US. The move comes after careful scrutiny from the Federal Trade Commission (FTC) and Federal Reserve Board of Governors under which it became apparent that Visa was violating current law that requires competition for debit network routing services. To avoid further immediate enforcement action, Visa agreed to amend its Core Selection of Payment System Rule 1.5.4.6 to clarify it does not apply to US debit transactions, and modify its Transaction Acceptance Device Guide, and its Acquirer Implementation Guide. The Federal Trade Commission announced on Nov. 22 that it would halt the investigation due to these changes, while reserving its rights to revisit this violation in the future. “RILA applauds the FTC and Federal Reserve for moving to quickly address this latest attempt by Visa to prevent competition in the payments market. Fish instinctively swim, the sun always rises in the East, and without watchful regulators Visa will always use its market power to act in anticompetitive ways,” said Austen Jensen, vice president of government relations at the Retail Industry Leaders Association. “This highlights the importance of Regulation II for keeping bad actors in check, and is a huge win for ensuring debit network competition and innovation for existing and emerging payments,” said Liz Garner, vice president at the Merchant Advisory Group. “MAG is very pleased with the diligence of the Federal Trade Commission and Federal Reserve Board’s investigation of Visa’s violations of Regulation II, and look forward to working with both agencies to ensure a smooth transition as merchants and acquirers go through the process of altering EMV deployments in light of the recent rule changes.”

Another Way to Save on Your Energy Bills

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.
