USEFUL RESOURCES FOR MEDICAL MARIJUANA AT WORK
HEMP LEGISLATION SIGNED

We have another short and sweet update for you this week!

MEDICAL MARIJUANA
After we sent our last week's Road Warrior, we had two of our attorney MBP's weigh in on the subject. Alicyn Craig of McCusker, Anselmi, Rosen & Carvelli (MARC) Law will be writing a piece on employment-related issues with medical marijuana in our October On The Road newsletter. Please keep your eyes out for that piece. Additionally, Steven Horowitz of Horowitz Law Group sent us over a couple of helpful resources for identifying employees who might be high while at work and what to do. If you have reasonable suspicion an employee might be high while at work, you should be keeping accurate records of the behaviors in question should the issue need to be escalated. You can use this form from the Department of Transportation to do so. You can also view this video when you have some time which may help identify behaviors that could indicate your employee may be high at work. The video is a bit dated but may be useful. We will continue to relay useful information and resources as the issue continues to progress in New Jersey.

CBD
On a related note, late last week Governor Murphy signed legislation allowing hemp plants to be grown in New Jersey. This will allow the hemp and CBD industries to grow in the state. This could have an economic benefit for our members in the c-store business with the boom in popularity of CBD products.

That's all for this week -
Sal Risalvato
Executive Director

Cumberland Farms Takes Aim at Massachusetts Liquor Laws
Cumberland Farms is taking aim at Massachusetts liquor laws, filing a ballot question with the state attorney general's office that would lift the state restrictions on the number of alcohol licenses a food retailer can have. The convenience store chain argues that it's time to modernize the state's archaic liquor laws, while package stores are gearing up for a fierce fight to defend their turf, reported The Boston Globe.

Hemp, Marijuana's Mild Cousin, Just Got The Green Light In N.J.
Hemp, a versatile plant genetically related to marijuana but with none of its psychoactive effects, can be grown freely in the Garden State under a bill Gov. Phil Murphy signed into law Friday. . . The law Murphy signed Friday repeals a law he enacted last fall, before Trump's action, that created a limited farming program. The new law says farmers must be registered with the state Department of Agriculture, and submit to periodic testing to determine whether a crop's THC level - the active ingredient that makes people feel high - is below 0.3 percent. If a farmer's hemp flunked the THC test three times within five years, the state could bar them from growing in the future.

FDA Issues Warning on Flavored E-Liquids
Yesterday, the U.S. Food and Drug Administration (FDA) issued warning letters notifying four companies that 44 flavored e-liquid and hookah tobacco products do not have the required marketing authorization, and thus cannot be legally sold in the United States. These new actions are part of the FDA's ongoing effort to investigate and take action against illegally marketed tobacco products amid the epidemic of youth e-cigarette use in America.
