MAGNUSON-MOSS
After four years of telling you how I fully expected the Magnuson-Moss legislation to pass, it has finally passed both houses of the legislature with the Assembly voting 74-0 on Monday. The final hurdle is to have Governor Murphy sign it into law. I am very confident that this will happen. For those of you with repair shops, this will be further ammunition for you to present to your customers so that they know they can bring their vehicle to you for repairs without voiding their warranty. Once signed by the Governor, car manufacturers will be required to mail a written notice informing those who purchased new cars of their rights. Coincidentally, three days before the vote in the Assembly, I received a call from a motorist who was told by Mercedes customer service that she could not bring her car to one of your shops because it would void her warranty. This is the exact situation we are trying to eliminate. I asked the motorist to put her complaint in writing, and send it to me.  I immediately sent her communication to every member of the Assembly as proof of our claim. 
 
INDEPENDENT CONTRACTOR
The independent contractor bill is another attempt from Trenton to overreach on employment laws. There has been a major push in the lame duck session to pass legislation that would seriously restrict how a business utilizes an independent contractor without classifying them as employees. NJGCA has been working with our usual band of coalition leaders that of course give us more strength with larger numbers in the small business community. Because of the efforts of this coalition, there seems to be a willingness to back off the effort and amend the legislation to be less onerous to those of you that utilize independent contractors rather than employees. I'm not sure how this will shape up, but we are actively involved. 
 
LIQUOR LICENSING
Last week, I notified you that there are more aggressive efforts to change the liquor licensing laws in New Jersey and I sent you links to my testimony in front of the Assembly Oversight committee. My testimony definitely raised some eyebrows and got people thinking, as I was called by several media organizations this week. This article first appeared on the New Jersey radio station 101.5 website and was picked up by NACS and quotes from my testimony to the committee. 
 
TURKEY DRIVE
I want to extend a huge thank you to both our members that donated to our Turkey Drive and the Young Professionals group for coordinating the drop off; and a special thank you to Environmental Alliance and Kneble's Auto Service Center for acting as drop-off points for turkey donations. Because of our members' generosity, we were able to donate 271 turkeys this year to families in need in Monmouth and Ocean counties. Our press release on the event was picked up by Insider NJ for more information. Your kindness is an example of what the Thanksgiving holiday is truly all about. 

 

On that note, I want to wish you all a happy and blessed Thanksgiving. This holiday is meant to give thanks for all of the blessings bestowed on us, good families, good friends, and a bounty of food. I hope you all enjoy the holiday and take a moment to reflect, relax, and give thanks for the blessings we have.

Want your technicians to become a NJ Emissions Inspector? We can help! Our new two-day class will provide all the information for becoming a NJ Emissions Inspector. Day one will consist of written test training and the State will administer the written test the very same day at our offices. Day two will be a hands-on training course to prepare you for the hands-on test. Class will run from 7:00am to 4:00pm on day 1. Class will begin at 12:30 PM on day 2. Cost is $479 for members.

The New Jersey Inspection Program requires vehicles that fail emissions inspection to go to a Licensed Certified Emission Repair Facility and have a Licensed Emission Repair Technician perform the repairs! When the new Emissions Inspection program begins, a list of Certified Emission Repair Facilities will be given to the vehicle owners who fail the New Jersey Emission Inspection. If you want your business name on the list - make sure you have a Certified Licensed Emission Repair Technician and you are licensed as a Emission Repair Facility! Those signing up for the FULL training course will attend sections 1-10. Full ETEP class fees for members are $2,195 and non-members are $2,395. Recertification fees for members are $729 and non-members are $879. This is the last class for the entire program, register early!

NJ Transit Head: Not So Fast on Move to Electrify Bus Fleet
New Jersey Transit is taking a go-slow approach toward electrifying its fleet of 2,500 buses, in part due to reliability concerns that have arisen in other places where battery-powered vehicles have been deployed, the agency's chief executive said Monday at a transportation infrastructure symposium in Newark. The cautionary note comes at the same time advocates in the city have joined environmentalists in pressing the state's mass transit agency to accelerate its transition to an all-electric fleet, saying that ridding city streets of exhaust-belching buses is a matter of urban health.

No Big Welcome in State House for Sweeney's Proposal to Waive 2% Tax Cap
Senate President Steve Sweeney's new proposal to give some school districts authority to exceed New Jersey's 2% property tax cap to offset cuts in state aid is drawing criticism from leaders on both sides of the aisle in Trenton. Gov. Phil Murphy, a Democrat, took issue yesterday with the proposal, which Sweeney (D-Gloucester) floated over the weekend; the governor suggested in a statement that a millionaires tax would be a better source of new revenue than higher property taxes. . .Senate Minority Leader Tom Kean (R-Union) also questioned Sweeney's proposal yesterday, noting in a statement that a broader overhaul of the state's school aid formula is warranted. "Lifting the property tax cap is not the answer," Kean said.

New Jersey Considers Alcohol License Changes

New Jersey lawmakers have wrapped up a series of hearings regarding what, if any, changes should and can be made to the way liquor licenses are doled out within the state, reports NJ1015.com. . . Many convenience store owners in New Jersey want the ability to sell alcohol. Sal Risalvato, executive director of the New Jersey Gasoline, C-Store, Automotive Association, said 79% of convenience stores elsewhere in the country are permitted to sell beer, but in New Jersey it's illegal. "Legislators finally recognize that New Jersey's liquor licensing laws are archaic and do not make any sense in this world," Risalvato said. "Convenience stores, with an underline underneath the word convenience, would like to satisfy their customers by being able to sell beer and wine, not all alcoholic beverages ... as a matter of convenience."

Oil Prices Rising After Recent Declines
This week, oil prices increased for the first time in two sessions, the Wall Street Journal reports. A weekly government report registering a smaller rise in U.S. inventories of crude oil triggered a corresponding rise in oil prices.

After Deaths, Ban on Flavored Vapes to Be Passed by New York City
The New York City Council agreed on Thursday to ban flavored e-cigarettes amid heightened concerns about the use of such products, making New York City the most populous jurisdiction in the country to impose such a ban. The ban would cover all flavored e-cigarettes and e-liquid vaping products, including ones that are menthol flavored. At least 30 members of the 51-member City Council have signed on as co-sponsors of the legislation.
