IMPORTANT NOTICE FOR SERVICE STATIONS
MASSACHUSETTS TO ANNOUNCE NEW VAPING REGULATIONS
SELF-SERVE 

SERVICE STATIONS
Yesterday, I had a meeting with DEP officials and learned some information that concerns me.  Service stations in Bergen, Gloucester, and Monmouth were batch-noticed in October that their UST Registration renewals expire on December 31, 2019. A number of reminders have been sent by NJDEP as well as NJGCA over the past year notifying UST owners/operators that new registrations would be tied to their station's A/B Operator certification. If a station owner or operator has not completed and passed the A/B Operator training by the time their registration expires on 12/31/2019 (or, alternatively, designated an outside/hired operator) then that station's UST Registration will not be renewed until it is complete. What does this mean? It means that if you do not have a designated A/B Operator at your facility, your UST Registration will not be renewed, and you will not be able to receive gasoline at your facility as of January 1. DEP has informed me that these batch-notifications went out in October to allow affected stations a 90-day lead time to meet this requirement. Keep in mind, if your check was cashed, it does NOT mean that your UST Registration will automatically be renewed. Rather, if you haven't heard back within a month of submission, and as DEP has limited staff processing renewals, there could potentially be a paperwork or administrative matter holding up the issuance of the renewal. It is imperative that you stop what you are doing and complete the UST registration forms and mail them in immediately with a check for the fee. Suppliers are aware of the deadline and will not deliver to any location that does not have a valid UST registration on January 1, or they will be fined $15,000 per delivery. Your registration must be in your hand on January 1.

VAPING
I cautioned in previous newsletters about the tidal wave coming across the country on vaping. It seems that every government official in every state wants their own set of regulations that include bans on flavors and menthol. There is a proposal in New Jersey that will also prohibit sales of e-cigarettes in your convenience stores and only permit them in specialized vape shops that do not allow anyone in the front door that is not 21. Massachusetts is including all of the above policies in their new regulations, to be announced on December 11th. Read more about that HERE
 
SELF-SERVE
We had several meetings this week with legislators on the issue of permitting self-serve gasoline in the state of New Jersey and we pointed out that we are the only state remaining that does not permit motorists to pump their own gas. Even one town on Long Island that has banned self-serve for 30 years is now reconsidering the ban because of motorists demands and marketplace conditions. Read more about that HERE.

Day one will consist of written test training and the State will administer the written test the very same day at our offices. Day two will be a hands-on training course to prepare you for the hands-on test. Class will run from 7:00am to 4:00pm on day 1. Class will begin at 12:30 PM on day 2. Cost is $479 for members.

Stop turning away work!

The New Jersey Inspection Program requires vehicles that fail emissions inspection to go to a Licensed Certified Emission Repair Facility and have a Licensed Emission Repair Technician perform the repairs! When the new Emissions Inspection program begins, a list of Certified Emission Repair Facilities will be given to the vehicle owners who fail the New Jersey Emission Inspection. If you want your business name on the list - make sure you have a Certified Licensed Emission Repair Technician and you are licensed as a Emission Repair Facility! Those signing up for the FULL training course will attend sections 1-10. Full ETEP class fees for members are $2,195 and non-members are $2,395. Recertification fees for members are $729 and non-members are $879. This is the last class for the entire program, register early!

Long Island Town May Finally Give Gas Station Owners Option Of Having Self-Service Pumps
The town of Huntington is proposing a law that would give gasoline stations the option of having self-serve pumps, CBSN New York's Jennifer McLogan reported Wednesday. Stations would still be required to have at least one full-service pump. It may be surprising, but right now the only places in America that mandate full-service pumps are New Jersey, parts of Oregon, and Huntington, N.Y.

NJ Moving Closer To Bans On Plastic Bags, Straws And Foam Containers After Delay
Some details are still being hammered out among legislative leaders who will hold a hearing Thursday on the much-debated plastics bill - the first action since September 2018. But the bill's primary sponsor said Tuesday that major components remain the same. The bill would ban plastic bags regardless of thickness, along with clamshell food containers made out of polystyrene foam, said state Sen. Bob Smith, D-Middlesex. Plastic straws would be available upon request at restaurants - something advocates for the disabled have pushed. Still being debated is when the bans take effect, Smith said. Another unresolved issue is whether to ban or place a fee on paper retail bags.

Massachusetts to Announce New Vaping Rules Dec. 11
Massachusetts Gov. Charlie Baker has announced that the state's temporary ban on the sale of all vaping products will remain in place until Dec. 11. At that time, permanent regulations from the state's Department of Public Health (DPH) will be considered, reports Cape Cod Today. The proposed new law, An Act Modernizing Tobacco Control, includes restrictions on the sale of tobacco products and limits the sale of flavored nicotine vaping products to licensed smoking bars where they may only be smoked on-site. The legislation grants the DPH new authority to regulate the sale of nicotine vaping products and to ensure that the public is informed about vaping's potential health effects.

Scaling Back State's Goals for Electric Vehicles
With less than two months remaining in the lame-duck Legislature, clean-energy advocates are pushing a slimmed-down bill promoting the use of plug-in electric vehicles, a move they hope will transform the transportation sector. The bill, the latest version of legislation (SCS-2252) that passed a key Senate committee 13 months ago, lays out specific time frames for getting more electric vehicles on the road and more charging infrastructure in place around New Jersey's main traffic corridors and communities. . . In certain aspects, the bill, sponsored by Sen. Bob Smith, a Democrat from Middlesex County, scales back some of the targets set in legislation that cleared the Senate Environment and Energy Committee.

Electric Consumers Shouldn't Have To Pay For The Expansion Of Electric Vehicles
New Jersey has the laudable goal of becoming a leader in the use of electric cars, buses and trucks. NJBIA supports this goal as part of the state's carbon reduction objectives. But we are deeply concerned about the cost of many of the electric vehicle (EV) policies being considered - and who they are looking toward to foot the bill. In short, it is you - the already overburdened ratepayer or business owner. Advocates and policymakers are proposing to spend hundreds of millions of dollars in subsidies for public charging stations and vehicle rebates, seemingly without consideration that New Jersey already has the 9th highest electricity rates in the nation.

Package Stores Challenge Cumberland Farms Alcohol Proposal
This summer, Cumberland Farms proposed a ballot that would let retailers sell beer and wine at any of its stores, with no cap on the number of locations. This week, the Massachusetts Package Stores Association has challenged the proposal's constitutionality, the Boston Business Journal reports. The ballot measure is scheduled to be put to a vote in the November 2020 election. As well as jettisoning the state cap on locations, the measure would also create a new license for food retailers to offer beer and wine for off-premise consumption. The ballot proposal also contains a requirement for stores to check IDs for all purchasers of alcoholic beverages via barcode scanners.

Each week, the Energy Information Administration publishes a list of average gasoline prices for the previous three weeks. NJGCA will begin including this list with the Weekly Road Warrior. Remember, these prices are reflective of self-serve everywhere except NJ.
