GREETINGS AND SAL-UTATIONS!

Dear NJGCA Member:

I recently met with Department of Environmental Protection (DEP) officials regarding excessive fines for non-compliance. Further details are below. I encourage you to observe DEP compliance standards to avoid these atrocious fines. DEP has become mean spirited and extremely unforgiving. We have invited a friendly representative from the DEP to attend our Fall Dinner Meetings to discuss this further and answer your questions.

We just held our Morris, Passaic, Sussex, & Warren Fall Member Dinner Meeting. I continue to be pleased with the turn out. Feedback was very positive and we got much needed information to our members.

10/01/2007:
Assembly members sue to get copy of toll road report
Lawmakers have sued the State in hopes of making a Treasury Department report on projected toll-road revenue public before the November elections. It is strongly believed that the Governor will push for a sale during the lame-duck session.

9/25/2007:
NJ gets a failing grade in infrastructure report; 30¢ Gas Tax increase proposed.
A new report by the American Society of Civil Engineers gives the State?s roads, bridges and airports a ?failing? grade. A 30¢ hike in the Gas Tax, soliciting more federal money and an increase in airport fares were all mentioned as possible sources to finance the multi-billion dollar repairs.

9/25/2007:
Frost Bite: Expect high heating costs this winter
With winter around the corner, the National Energy Assistance Directors? Association has cited a colder winter and lower fuel-oil inventories for a projected surge in winter heating costs.

DEP COMPLIANCE & FEES NOTICE

NJGCA recently met with chief DEP representatives to discuss the problems of excessive non-compliance fines.

Our sentiments were mixed at the conclusion of our meeting. To put it quite bluntly, the DEP has gone from a department with a clear goal of protecting the environment to a fine generating operation. Many inspectors will now fine you for small violations, even if they are administrative (and not environmental) in nature.

It is no secret that the state is in dire fiscal condition and DEP has become a fine generating operation.

We strongly encourage you to review DEP policies and stay compliant. DO NOT give DEP an excuse to fine you.

NJGCA has an agreement with ATS Environmental Services to assist you if you are unsure of your compliance status. ATS has agreed to inspect your facility for FREE if you are an NJGCA member in good standing. Non-members must pay $250 for this service. I urge you to take advantage of this program.

DIESEL FUEL BULLETIN

On-road diesel regulations have recently been updated to reflect lower sulfur content.

With this change are strict instructions on how pumps are to be labeled; either with Low Sulfur Diesel (500ppm) or Ultra Low Sulfur Diesel (15ppm) stickers.

Though this change took effect in June of 2006, there are reported incidents in which pumps have been mislabeled and consumers received the inappropriate fuel. The end result is incredible damage to customers? engines and lawsuits filed against station owners. Fines may also be levied up to $35,000 per day.

No one wants a law lawsuit or legal headaches; please make sure all of your pumps are properly labeled.
