Good news for members in NJGCA’s Association Master Trust (AMT) health coverage program! You should've recently received a dividend in the form of a credit on your July healthcare premium. The credit was equal to 3% of the total health coverage premiums you paid in the 2016 calendar year. Once again, NJGCA members enrolled in this plan receive benefits that no other health insurance company can offer, because if other health insurance companies have money left over after all claims have been paid, that excess money is returned to their stockholders. In essence, because AMT is a self-funded trust, AMT planholders are our version of “stockholders,” and any money left over after claims are paid is then returned to YOU.  
 
It is universally recognized that health coverage premiums are too high, and I agree, but I must assure you that if you compare apples to apples, the premiums you will pay to our self-funded trust will be lower than any premiums you will pay to another health insurance company.  And of course if those lower premiums still amount to more money than is needed to pay claims, which it often does, you get the added bonus of AMT returning that excess to you! State law requires that only members in good standing with one of the 15 Associations that comprise this Trust can purchase health coverage through AMT.  This is a valuable benefit to NJGCA members, and you are leaving money on the table if you don't shop your healthcare coverage every year and compare apples to apples. It is rare that AMT does not provide a better plan for less money.  Congratulation to the NJGCA members who take advantage of this program! There are many members who have received over $5,000!
 
I am happy to report that after 5 years of trying to get NJ DEP to consider eliminating Stage II Vapor Recovery in New Jersey, I received official word this week that rules have been proposed that will allow you to dismantle and eliminate the use of your Stage II Vapor Recovery Equipment!  The rules were just sent to me this morning, and it’s a 48 page document that I have not yet reviewed completely. I will report back to you hopefully next week with my findings about what will be required. As I mentioned last year when I began making progress on this, it will not be as simple as "turning off" your Stage II equipment. I need to review the details to find out the good, the bad and the ugly. Overall, I view this as good news.
 
As I mentioned last week, we knew that the expansion of paid family leave would pass the legislature. It did and is now waiting for the Governor’s signature. As I also said last week, as much as we would like Governor Christie to veto the bill, we are not sure that will ultimately be a victory. We risk total defeat if Democrats get the chance to pass an even more dangerous bill next year with a sympathetic Phil Murphy (who is heavily favored to win) in the Governor's chair.

Under current law, businesses with 50 or MORE employees must allow an employee taking paid family leave to return to their job at the end of the leave. The business is allowed to hire someone temporarily while the employee is on leave, but when the employee returns, they get their job back and the interim worker is terminated. Luckily, the burden of finding and hiring someone who will work for 6-12 weeks at a time in a temporary position, does not apply to 99% of our members.
 
Businesses with 50 employees or LESS are currently exempt from “saving” an employee’s position for them to return after they take leave. This bill would LOWER the exemption from businesses with 50 employees or less to businesses with 20 employees or less, and also increases the amount of time employees are entitled to, and the amount of money they will receive during their leave. Though we aren’t happy about the other components of this expansion, reducing the exemption from businesses with 50 employees or less to businesses with 20 employees or less is something we simply cannot stand for. And yet, we fear that if Governor Christie vetoes this bill and the Democrats get a chance to try again next year, they are likely to pass a bill with no exemption at all, if Phil Murphy is elected Governor.
 
We are working right now to get Governor Christie to conditionally veto the legislation, meaning that he removes the language that changes the exemption from businesses with 20 employees or less, and keeps it at businesses with 50 employees or less. We will let you know how things turn out. 
 
Two other quick legislative notes:
  • The tire safety legislation passed last week and is on the Governor’s desk. As a reminder, this legislation lays out specific safety standards that must be applied whenever a used tire is offered for sale. We expect this legislation to severely limit the number of used tires that can be sold, and ultimately should result in your customers purchasing new tires instead. We do expect that the governor will sign this legislation.
  • Once again, the Legislature has passed a bill to raise the state minimum age to purchase tobacco products from 19 to 21. Like paid family leave, if the Governor does veto this, we expect it to be quickly passed in 2018. Should Phil Murphy become Governor, it is expected that he will sign this too in a heartbeat… And Democrats may even feel more emboldened to pass an even more restrictive bill.
Finally, it is hard to write a Road Warrior this week without mentioning what transpired between July 1-3 in Trenton. You all know that the constitutional deadline to pass a budget by midnight on June 30th was not met by the Legislature. Constitutionally, the State was required to shut down at midnight on Friday night. As a result, everything but essential services were closed until July 4th, which just so happened to be a holiday when the State would have been closed anyway.
 
In the days leading up to June 30th, we worked diligently to gather information about how a shutdown would affect you and your business. We sent you a Wildfire Alert to give you advance notice that a state shutdown could include the closing of the lottery. We worked hard last Thursday and Friday to get the Governor to sign an executive order which would allow lottery to remain open.  It wasn't until I spoke with the Director of the Lottery at 6 am Saturday morning that I learned that lottery was never shut down, and that the Governor did indeed sign an executive order stating that lottery sales could continue, even while the rest of the state was shut down. 
 
Additionally, because I had a concern that emissions inspections may also be affected, I reached out to Chief Martinez at MVC on Friday morning as well. He assured me that even though the MVC would have to shut down at midnight, since the inspection process is performed by a private contractor, a state shutdown would not prevent us from performing emissions inspections. Once I received that assurance, I realized there was no need for me to send a second Wildfire Alert to those of you operating repair shops since you would not be affected.
 
I hope you all had a nice 4th of July holiday despite all of the chaos caused by the State of New Jersey.

Stop turning away work!!  The New Jersey Inspection Program requires vehicles that fail emissions inspection to go to a Licensed Certified Emission Inspector for Repairs! When the new program begins, a list of Certified Emission Repair Shops will be given to vehicle owners! If you want your business name on the list – make sure you have a Certified Licensed Emission Repair Technician & an Emission Repair Facility License!

This class runs on Wednesdays from 1:00 PM to 9:00 PM for 4 weeks.
Class dates are Wednesday, July 19, 26, August 2nd and TUESDAY August 8th.

Fees for members are $635 and non-members are $765.

New Jersey Unsafe Used Tire Legislature Goes to Governor
New legislation that prohibits the sale of unsafe used tires in NJ has been sent to Gov. Chris Christie. The bill (A 3896) would prohibit the sale of unsafe used tires that pose a risk to New Jersey motorists and impose a fine on a business that sells a tire that exhibits any one of several unsafe conditions such as worn-out tread, visible damage, or improper repairs. According to the National Highway Traffic Safety Administration (NHTSA), worn-out tires (Tires worn to 1/16th of an inch) are three times more likely to be involved in a crash than tires with sufficient tread depth. Tires with exposed steel belts or other internal components threaten a tire’s structural integrity, while bulges indicate possible internal damage that can lead to tread separation. The U.S. Tire Manufacturers Association (USTMA), the Tire Industry Association (TIA), and the New Jersey Gas Station-C-Store-Automotive Association (NJGCA) all support the bill.  “This legislation will help prevent high-risk, used tires from jeopardizing safety on New Jersey roads,” said Anne Forristall Luke, USTMA president and CEO. “We urge Gov. Christie to sign this important consumer protection legislation,” Luke adds. “We are very appreciative of Assemblywoman Sumter and Sen. Nicholas Scutari (D-Linden) for their leadership and persistence advance this measure through the Legislature to the governor’s desk.”

States yanking electric-car incentives and slapping on new fees to pay for infrastructure
For drivers of electric cars, going green is starting to take more “green.”  A growing number of states are imposing new fees on electric vehicles as officials scrounge for ways to pay for infrastructure projects they say are long overdue. At least five states, including California, passed bills targeting the cars this year, bringing the total number with fees on the books to 13. The charges generally range from $100 to $200 a year.  The passage of the fee in California -- home to one of the most prominent names in electric vehicles, Tesla Motors -- underscores the shift in sentiment toward the technology. Many states initially encouraged drivers to make the switch to cleaner cars through tax incentives and other measures.  But now, cash-strapped and pothole-ridden, states are asking the eco-friendly to pay up.  Proponents of the fees say the issue is one of fairness.  Since 2013, 24 states and the District of Columbia have moved to raise their gas tax, including 5 states just this year, according to the National Conference of State Legislatures. In California, a 12¢ hike in the gas tax is expected to pay for nearly half of the state's $52.4 billion infrastructure package to repair roads and alleviate congestion. But since electric cars don't need gas, those drivers don't pay the tax -- even though they use the same roads as traditional cars. California's new $100 annual fee on electric vehicles will go into effect in 2020 and is expected to raise $200 million over the next decade.

2 Bills in Congress That Could Save Vaping
The vaping industry received encouraging news as a subcommittee within the House Appropriations Committee on Agriculture approved a bill with language that may ease U.S. Food and Drug Administration (FDA) rules on e-cigarettes and vaping products. Language within the U.S. House of Representatives’ agricultural appropriations bill for fiscal year 2018 would change the so-called “predicate date,” the date from which products can be grandfathered into a less restrictive FDA application process, from Feb. 15, 2007, to Aug. 8, 2016. The 2007 date is a damaging end point for e-cigarettes and vaping products, because most were not on the market back then. If not grand-fathered in before that predicate date, vaping, cigar and other tobacco products would have to undergo a rigorous, expensive FDA application process to stay on or go to market. The 2007 date is particularly challenging to the vaping industry because that is the year e-cigs were introduced in the United States. Requiring a strict review of all product since then would effectively gut the market. 06/28/2017:
Wawa application faces opposition in Oakland
An Oakland borough ShopRite's landlord came out swinging in the first hearing for a proposed Wawa store and gas station before the Oakland zoning board this week. Attorney Carl Rizzo, who represents the landlord, challenged everything from signage on gas pumps to who has jurisdiction over the section of Route 202 where the Wawa would be built. Wawa is seeking seven variances, including exemptions from the borough's rules on signage, retaining walls, and impervious coverage, as part of its bid to build a store and gas station at 101 Plaza Road, where a Burger King now stands. Jayare Associates, the owner of the property next door, where a ShopRite is located, is objecting to the project. At the hearing, Wawa attorney Gail Price eventually persuaded the board to accept “straight line diagrams” indicating Route 202 is under county jurisdiction. However, waiting until the evening that hearings begin to notify Wawa of a possible deficiency in its public notices indicates the level of animosity attending the application. Rizzo continued his criticism of the application throughout the evening, arguing that the applicant should make a better effort to reduce the project's impervious coverage, questioning Wawa's ability to limit the site's customers to those driving cars and small trucks, and suggesting that the proposed gas pump lettering constituted further signage that would require variances.  To read more about the project, click the link above.

We have had a number of NJGCA members successfully reduce their rate per kWh signing up through our energy saving program. We know it's difficult to collect 12 months worth of previous electric bills to get an "accurate" analysis when comparing a variable rate to a fixed rate, but we now have another option available. 

This new solution is a power purchase option; the other program is still in full force and has saved members thousands of dollars. If you sign up for the power purchase option, you will be grouped with other NJGCA members until the minimum kW demand is acquired. By pooling the member's usage together, you will be able to take advantage, as large energy users do, and receive a lower kWh rate.

Each member will receive their own contract. Each member is responsible to sign and return the agreement the day it is received in order to secure the price for their group.

Please do your due diligence, so when you receive the proposal and the agreement you will be able to make an intelligent decision.

If by chance, you still want us to assess you bills, to give you a price to compare, we will require 12 months of your most recent utility bills.

There are no bills required, but we would still like to have one bill per meter on file to check account #'s, meter #'s  service addresses and other pertinent information incase there is a problem.

The term of the agreement is for 12 months. During this term period, you will have price protection against any energy price increases along with a low fixed kWh rate.
