WORKPLACE SCHEDULING BILL
Last year, we discussed the possibility of a workplace scheduling bill which would allow the government to micromanage how you schedule employee's hours and so far have been able to prevent this from accelerating through the legal process. However, it is now again being discussed with urgency amongst legislators. Efforts are being made to mandate how you schedule your employees for work. It appears that unions and other workers' rights groups are advocating for a two week notice for employees schedules to be presented to them. When workers have to be called in on a day they are not scheduled to work, as they sometimes are emergency situations; there will be payroll penalties that you will be forced to pay. We don't have all of the details yet, but you can rest assured that NJGCA along with our coalition of other small business trade associations will be fighting very hard to stop this. I am sure I will be asking for some of you to testify at any Labor Committee hearings that the legislature may hold. I'll keep you updated as details emerge.
BMW
For our auto repair members: We were recently informed that BMW's with a certain engine have a defect that causes the car to use excessive amounts of oil. It might be a nice courtesy to mention this to your customers who have these vehicles serviced in your shop. This is a great piece of information for your customer if they are complaining of increased oil consumption but more importantly, there may be a legal remedy for your customer.
CORPORATE TRANSPARENCY ACT
We heard of indications that there would be committee hearings this week on the Corporate Transparency Act and we planned to notify you to contact members of Congress prior to hearings once we learned they had been scheduled. However, surprise, not only were there no hearings, but the entire House of Representatives voted on it Tuesday night. You can read more details about the Corporate Transparency Act here from NFIB, which is leading the fight for changes to the bill. It would require all businesses with fewer than 20 employees to file an annual form with the federal government listing the names and personal information of every person with an ownership stake in every LLC or corporation in the nation. Failure to file the form, or to file it incorrectly or incompletely, will make you liable for huge penalties of up to $10,000 or three years in prison. Every member of the New Jersey delegation voted in favor except for Congressman Jeff Van Drew (D) from South Jersey. The bill must now be considered by the US Senate.
TURKEY DRIVE
NJGCA is organizing another turkey drive ahead of the Thanksgiving season! Last year, we were able to donate 213 turkeys to Fulfill NJ, the Monmouth and Ocean county food bank. This year, we hope to be able to donate even more turkeys to make sure families all over New Jersey have Thanksgiving dinner. Feel free to notify your customers of the drive to donate. It would be great if your customers dropped off turkeys to you and then you can drop them off at one of the designated drop off points listed below. Turkeys should be kept FROZEN. Turkey drop off locations are listed below and must be dropped off by Wednesday, November 20th by 5 PM. Contributions will also be accepted our website for online contributions will be up very soon. Help us reach our goal of donating 350 turkeys this year!

Want your technicians to become a NJ Emissions Inspector? We can help! Our new two-day class will provide all the information for becoming a NJ Emissions Inspector. Day one will consist of written test training and the State will administer the written test the very same day at our offices. Day two will be a hands-on training course to prepare you for the hands-on test. Class will run from 7:00am to 4:00pm on day 1. Class will begin at 12:30 PM on day 2. Cost is $479 for members.

The New Jersey Inspection Program requires vehicles that fail emissions inspection to go to a Licensed Certified Emission Repair Facility and have a Licensed Emission Repair Technician perform the repairs! When the new Emissions Inspection program begins, a list of Certified Emission Repair Facilities will be given to the vehicle owners who fail the New Jersey Emission Inspection. If you want your business name on the list - make sure you have a Certified Licensed Emission Repair Technician and you are licensed as a Emission Repair Facility! Those signing up for the FULL training course will attend sections 1-10. Full ETEP class fees for members are $2,195 and non-members are $2,395. Recertification fees for members are $729 and non-members are $879. This is the last class for the entire program, register early!

New Multi-State Initiative Looks To Reduce Car And Truck Emissions
There's a new multi-state initiative in the works, with New York, New Jersey, and Connecticut all included, looking to reduce car and truck emissions - but it could mean gas prices going up. The new program - the Transportation and Climate Initiative (TCI) - looks to tackle the next frontier in climate change, according to Bruce Ho, of the Natural Resources Defense Counsel. . . "I think it's a very bad idea," said Sal Risalvato, with New Jersey Gasoline, C-Store and Automotive Association. He says the Tri-State area is already making enough progress on emissions and this would be an unnecessary step. He says the most important green initiative right now is "the way that engines operate, the amount of fuel that is being consumed." He adds that states would have to share the revenue generated from the TCI, which is projected to start in 2022.

Governors Eye Regional Gas Tax To Fund Transition From Fossil Fuels
Governors from several northeastern and mid-Atlantic states may have found a way to reduce pollution from cars and trucks and buck the Trump administration, which is trying to weaken auto emissions standards and gut efforts to curb climate change. Under a regional cap-and-trade plan that a dozen states still are developing, drivers would pay more at the pump through higher prices for gas and diesel. The revenue would be invested in mass transit, electric-vehicle charging and other transportation infrastructure. Republican and Democratic governors and state lawmakers will have to decide whether to back the plan to address the largest source of carbon emissions - and pass on the costs to consumers in what opponents of the proposal are already calling a gas tax.

Paterson: Gas Station Robbery Is Second In 3 Days
A gas station in the city's 4th Ward was robbed at gunpoint late Thursday and investigators are looking into the possibility that the crime is connected to a similar incident in a different part of Paterson two days before, police said. The station, which does not have a name or a sign, is located in a shopping plaza on Lafayette Street and connected to a laundromat.

E-Cig Industry Fractures Over Looming Laws As Big Tobacco Plays The Long Game
The high bar anticipated in forthcoming FDA requirements for e-cigarettes to stay on the market, combined with the Trump White House's push to ban flavors in the meantime, threaten to whittle the e-cigarette industry down to just a few big players. Tobacco giants like Imperial Brands, Altria and R.J. Reynolds have added lobbying muscle and amplified the message that they welcome regulation of their e-cigarette brands and are ready and willing to prove their products' worth. Meanwhile, smaller e-cig makers and retailers are allying with free-market ideologues, suing governments and appealing directly to the public.

Coalition Pushes for Fairness in Work Schedules
A coalition called Fair Work Week NJ held a news conference in Teaneck on Wednesday to draw attention to the problem. The group is made up of liberal advocacy groups and labor unions who say low-wage workers are being taken advantage of by unfair scheduling on the part of management. . .researchers found that unpredictable shifts and work schedules are common in the food-service and retail industries, which employ 17% of the American work force. Many of the workers get little notice of what days and hours they will be working in a particular week and, perhaps more importantly, when shifts are canceled, according to the report released by The Shift Project, an institute at the school.

Northeast Governors Explore Regional Standards For Vaping, E-Cigarette Products
Top officials from New York, New Jersey, Connecticut and Pennsylvania are considering regional standards for vaping and e-cigarette products, including implementing product safety regulations for nicotine, CBD and other cannabinoid vaping products. The recommendations were presented Thursday morning by Judith Persichilli, New Jersey's acting health commissioner, during a closed-door information session in New York City that was chaired by New York Gov. Andrew Cuomo. Others participating were New Jersey Gov. Phil Murphy, Connecticut Gov. Ned Lamont and Pennsylvania Gov. Tom Wolf, as well as health officials from a half-dozen other Democrat-led states.
